WASHINGTON, D.C. – House Ways and Means Committee Chairman Kevin Brady (R-TX) today released the following statement after President Trump signed into law Chairman Brady’s resolution (H.J. Res. 42). This resolution blocks an Obama-era Department of Labor regulation that has prevented states from implementing a bipartisan 2012 law allowing states to drug test certain unemployment insurance (UI) applicants.
“This new law repeals an Obama Administration overreach and lays the groundwork for states to help more people get back to work—a win for families, workers, job creators, and local economies. I’m proud to have led this effort to help more Texans and people across the country find a job, earn a paycheck, and climb the economic ladder,” said Chairman Brady.
BACKGROUND: H.J. Res. 42 disapproves and blocks a rule submitted by the Department of Labor relating to drug testing of unemployment insurance applicants. In 2012, in Public Law 112-96, Congress repealed a 1960s-era ban on drug screening and testing of unemployment insurance applicants and allowed states to conduct drug testing of people receiving unemployment benefits.
